Once you file or receive a Notice of Opposition and it is received by the Trademark Trial and Appeal Board (TTAB), the applicant has forty days from that date to file a response.If no response is filed within that period, the TTAB will issue a default judgment against the trademark application and it will be cancelled by the U.S. Patent and Trademark Office.If a response is filed, the process becomes similar to litigation, as there will be a settlement conference, discovery, and trial.
